Our client was inside his house when the police served a search warrant. They found a few ounces of marijuana underneath a bed and in the bathroom. At trial, we were able to present evidence that the contraband could have belonged to someone else, thus disabling the states argument that our client had dominion and control over the marijuana. It also didn’t hurt that we called out the investigation and that the state presented no testimony from the other residents of the home to testify that it was not their marijuana. We called no witnesses, relying only on our cross-examination of the arresting officers as fuel for our argument. After a two day trial, the case went to the jury for their verdict. They came back with a NOT GUILTY verdict.
