Our office successfully defended a client facing a serious felony charge with significant potential consequences. From the outset, we conducted a thorough investigation and strategically pursued discovery, including taking depositions.
During the deposition process, we uncovered substantial credibility issues. Witness testimony revealed inconsistencies, the evidence failed to support the prosecution's theory, and the alleged victim omitted critical information. Specifically, her own violations of applicable HOA rules. Testimony also established that the alleged victim was recording the HOA meeting in a disruptive and provocative manner, further undermining her credibility and account of the incident.
Following the depositions, our office elevated the matter to the assigned State Attorney's supervisor, clearly outlining these deficiencies and demonstrating that the alleged victim was, in fact, the primary instigator in the incident.
After considering these findings and arguments, the State entered a Nolle Prosequi, formally dismissing the charge against our client.
