Case
State v. C.G.; Case No. 562014MM000963 (St. Lucie County)
Arresting Agency
Florida Highway Patrol
Result
Charges Dropped
The Trooper claimed our client was traveling with window tint that was too dark. He also stated in his report that our client’s tag was obstructed by a black plastic dealership tag bracelet. We filed a Motion to Suppress the possession of marijuana charge, arguing that the tint was within legal limits (we had it independently tested and documented) and that the tag was not obscured to the point that would constitute a violation of Florida Statute 316.605(1). The prosecutor received our motion and made us an offer of ‘time served’ that we rejected. On the morning of the hearing, the prosecutor dropped the case.
