Drug trafficking & gun charges dropped after motion to suppress
State v. T.S.; Case No. 2006-CF-5068(St Lucie County)
Count 1 – Trafficking in Cocaine more than 28 grams less than 150 Kilo.
Count 2 – Possession of Cannabis under 20 g.
Count 3 – Possession of firearm by a convicted felon.
Arresting Agency: Fort Pierce Police Department.
Case Summary: our clients home without a warrant. The only way they were going to win this argument is if they could convince a judge (and later the 4th District Court of Appeals) that exigent circumstances existed which trumped the warrant requirement. Don’t think so. The fire was extinguished. No one was hurt. No emergency or exigency existed when the police showed up. Third, the police action of entering into the home to look at the cocaine tainted the search warrant. This would make all evidence found pursuant to the search warrant inadmissible at a trial against our client.
