Felony Xanax charge dropped – DUI pled to lesser of Reckless Driving

Case Summary: Our client was in a single car crash off of I-95 in St. Lucie County. The trooper found E.W. slumped over the steering wheel in her vehicle, but there were no injuries. He also found some Xanax pills in the vehicle and had E.W. perform some field sobriety exercises and take a breath test. Her breath test reading was below the legal limit (.08) and we were able to document a lawful prescription for the pills found in the vehicle. After a friendly series of negotiations with the prosecutor, a resolution was agreed upon.
Result: Our client entered into an agreement for a reckless driving charge and one (1) year of probation. The felony drug charge was dropped as was the DUI.
