How to Apply for a Hardship License in Florida After Your First DUI Arrest

A DUI in Florida can result in administrative and court ordered suspension of your driver’s license, often for six months to a year, depending the circumstances. Fortunately, the state allows eligible individuals to apply for a hardship license—a restricted license that permits driving for business purposes in order to maintain their livelihood, like work, school, grocery shopping, and medical or legal appointments.

What Is a Hardship License?

A hardship license is a limited-use license issued by the Florida Department of Highway Safety and Motor Vehicles (FLHSMV). It allows you to drive under specific conditions while your regular license is suspended due to a DUI.

Please note you only have ten (10) days [from the date of your arrest] to apply for a hardship license in the state of Florida.

Step-by-Step: How to Apply for a Hardship License in Florida

  1. DUI School

You must enroll and provide proof of enrollment in a Florida state-approved DUI education program before applying for your hardship license.

  1. Request for Eligibility Review – Application

You must submit your application with the Bureau of Administrative Reviews by mailing or emailing to the office nearest to your residence. (There is a list of locations provided on the second page of the application.)

  • You’ll need to send:
    • Proof of enrollment in DUI school
    • A completed Request for Eligibility Review Application (Form HSMV 72034)
    • A copy of the DUI citation
    • Completed Credit Card Authorization Form to provide Payment for fees ($25)
    • Cashier’s Check or Money Order made payable to the Division of Motorist Services should you wish to submit your application by mail.

Once your application has been reviewed by the Bureau of Administrative Review and approved, you will receive an authorization for reinstatement via email. You will need to take the authorization for reinstatement to your local DMV office.

  1. Pay Reinstatement Fees

If approved, you must pay:

  • $45 Reinstatement fee
  • $31.25 License fee
  • $130.00 Administrative Fee

Note:

  • If you fail to complete DUI school within ninety (90) days of enrollment your restricted license will be cancelled.
  • You must strictly follow the terms of your restricted license.
  • Driving without a valid hardship license is a criminal offense and may result in further penalties and potentially a revocation of your original bond.

Bottom Line:
A hardship license can help you regain limited driving privileges after a first DUI arrest and administrative suspension in Florida, but the process requires enrolling in DUI school, submitting a request for eligibility review to the Bureau of Administrative Review and demonstrating need.

These steps are only for first time DUI arrest.
