Sex offender status removed from registry

State v. M.W.; 1998-CF-3676 (St. Lucie County)

Arresting Agency: Federal Bureau of Investigation.

Case Summary: Under a law recently passed by the Florida Legislature, called the “Romeo and Juliet” law, some people are now eligible to petition the Court for removal from the sex offender registry. There are strict requirements in order to be eligible, and then there is the final hurdle convincing a Judge to actually sign off on it. In this instance our client had been a stand-up guy his whole life. The relationship he had engaged in took place over a decade ago and was consensual. After close to an hour-long hearing in front of Judge Mirman, even the prosecutor recommended that our client be removed from the sex offender registry.
