Our client, the passenger in a vehicle entering the Okeechobee Music Fest, was looking forward to a few days of nice weather and great music. As the vehicle entered through the entrance gates, a K9 alerted law enforcement to their vehicle. They were then escorted to a search area where the vehicle and all occupants were searched. Inside the vehicle, a black bag was found containing 88 grams of cocaine and 35 grams of MDMA (Ecstasy/Molly.) All were taken into custody and charged with Trafficking in Cocaine and MDMA (Ecstasy/Molly.) Fortunately for our client, she hired the Law Office of Brian H. Mallonee to handle her case. We immediately began extensive research and discussions with the Office of the State Attorney. We forwarded a Motion to Suppress to the prosecutor claiming there was an involuntary search of the vehicle and constructive possession. The State was going to have a difficult time proving who the drugs actually belonged to and that all occupants had knowledge that they were in the vehicle. Within three days of hiring our office, we were able to get all charges dropped.
